Terms of Service
(01) GENERAL TERMS• Prices are subject to change based on demand.
• I have right to decline any commission for any reason, such as being too complicated or too uncomfortable for me to work on.
• Clients aren't permitted to use the art in training for AI/ML models and/or NFT.(02) PAYMENT• The only acceptable currency is USD. Payment will be done by PayPal or any other method based on my accessibility to them.
• All commissions must be paid 100% upfront. For commissions with end cost 200$ or more I'm open to discuss splitting the payment.
• Upon a split payment, I will stop the progression half-way and will prioritize those who have paid in full.
• Do not send me any payments before we have agreed on the commission and I have given you a slot.(03) PROCESS OF COMMISSION AND DELIVERY• All commissions slots are forming the line based on payment date. You will be informed on your position in line and estimated time of me starting to work on it.
• My work requires a lot of time. Commission may take up to couple of days or less, a week or several months depending or factors such as complexity of commissioned piece, my own health, other work and family issues. Usual estimated delivery time is in range of two weeks.
• Please, be ready to provide me a FULL DESCRIPTION of your commission to the best of your abilities. It may be in text, photos, different art pieces etc. It's important to provide me clean and sufficient references or discuss them, otherwise I am free to change, add or substract details based on my vision.
• From time to time, I post work in progress pictures on my social media pages (usually X).
• If anything comes up that will slow the progression of the initial estimated delivery time, I'll inform you ASAP.
• If there's any questions or possible changes that may be arisen while I work on your commission, I'll contact you to discuss them.
NOTE: ANY CHANGES AFTER I SEND YOU THE FINAL VERSION WILL BE DECLINED.(04) COPYRIGHT AND USAGEI, VFlashback (The Artist), claim the rights to the produced drawings / art pieces, not the customer / commissioner. Therefore The Artist is allowed to use the copyrighted artwork.
The customer / commissioner is allowed to:
• Use the commissioned piece for personal use (i.e. icons, profile pictures, banners, or as references for other artists);
• Print the artwork and claim the character as their own, but not the artwork itself;
• Use the artwork to promote themselves (providing a credit will be appreciated).
• Commercial usage of the artwork must be stated clearly to The Artist and discussed. Without a proper acknowledgement and given permission it will be considered a copyright infringement.
The following is considered copyright infringement:
• Refering to previous statement, reproducing/using the copyrighted artwork commercially without permission. (Do clarify with me first if you do want to make a profit and branding purposes - i.e. Patreon, Twitch, Youtube, merchandise, game assets, etc.)
• Posting the artwork without the signature or removing it.
• Claiming the artwork as yours.
• Altering the artwork without my consent (this includes adding filters).(05) WHAT DO YOU RECIEVE?
• Final version of the artwork is PNG/JPG file that you will get through the link to Google Disc.
• Receiving the CLIP file must be discussed and may happen upon additional charge.
